Sengketa Pilkada Kaimana: Pasangan Freddy-Sobar Ungkit Syarat Dukungan

In a recent development at the Mahkamah Konstitusi, the Preliminary Hearing of Case Number 254/PHPU.BUP-XXIII/2025 on the Dispute of the General Election Results for the Regent and Deputy Regent (PHPU Regent) of Kaimana District has brought some shocking revelations to light.

The hearing, led by a Panel of 2 Judges consisting of Vice Chairman of the Constitutional Court Saldi Isra, along with Constitutional Judges Ridwan Mansyur and Arsul Sani, saw Candidate Pair Number 2 Freddy Thie and Sobar Somat Puarada (Petitioners) contesting that their vote count of 14,907 or 48.51% was affected by violations committed by the Kaimana District Election Commission (the respondent) and Candidate Pair Number 1 Hasan Achmad and Isak Waryensi (related parties), qualifying for disqualification or a Recount of Votes.

During the presentation of the main petition, M. Imam Nasef, the legal representative of the Petitioners, highlighted that the designation of the Related Parties as the Candidate Pair for Regent and Deputy Regent of Kaimana District was legally flawed due to not meeting the minimum 10% threshold of valid votes.

This discrepancy arose because the support and valid vote count from the National Mandate Party (PAN) could not be considered in the combined valid votes of the endorsing political parties. The inability to provide evidence of the withdrawal of support agreement from the Petitioners and other supporting parties until September 4, 2024, raised significant concerns.

Moving forward, Nasef also pointed out the inconsistency of the respondent after the Kaimana District Election Supervisory Agency held a closed-door meeting attended by the respondent and related parties to resolve the Petitioners’ registration issues as the Candidate Pair for Regent and Deputy Regent of Kaimana District on September 14, 2024.

Moreover, Nasef highlighted the respondent’s oversight in accepting the nomination of the Related Parties as the Regent and Deputy Regent of Kaimana District, as the regent candidate from the Related Parties, Hasan Achmad, registered using an expired ID card.

In light of these arguments, the Petitioners have requested the Court to disqualify the Related Parties for not meeting the requirements as Candidate Pairs for the 2024 Regent and Deputy Regent Elections in Kaimana District. Furthermore, they have urged the Court to declare themselves as the Elected Regent and Deputy Regent of Kaimana District in 2024.
